FUJIFILM instax Prize Draw Promotion Terms and Conditions

What is this promotion?

  1. This instax prize draw promotion (“Promotion”) offers FUJIFILM NZ Limited (“FUJIFILM NZ”) customers (“FUJIFILM Customers”) who purchase one Qualifying Product (described further below) the right to redeem one free instax branded 40oz drinking tumbler (“Tumbler”) and to go in the draw to win 1 of 5 $500 gift card bundles described in paragraph 16 (“Prizes”).

How long does the promotion run for?

  1. The Promotion commences at 00:01 on Wednesday 26th June 2024 and continues until 23:59 on Friday 23rdh August 2024 (“Promotional Period”). For the avoidance of doubt, this Promotion does not apply to purchases of Qualifying Products made after 23:59 on Friday 23rd August 2024 or to entry forms received by FUJIFILM NZ after that date and time.

How do I participate?

  1. To participate in the Promotion:
    • you must purchase a qualifying instax product set out in paragraph 13 below from an authorised FUJIFILM NZ outlet (a list of which is available at https://www.nz.fujifilm.co.nz/authorised_instax_dealers/ (“Authorised FUJIFILM NZ Outlet”)  (“Qualifying Product”) during the Promotional Period, while stocks last, and keep evidence of your purchase;
    • you must submit a properly and fully completed entry form at instax.co.nz/promotions. The entry form will require the following key details:
      • your full name and contact details;
      • your preferred delivery address;
      • the date of the purchase of your Qualifying Product;
      • the name of the Authorised FUJIFILM NZ Outlet that you purchased your Qualifying Product from, or a copy of the receipt that was generated from your purchase through instax.co.nz; and
      • proof of the purchase of the Qualifying Product. This may include a scan or photo of the original receipt issued for the Qualifying Product by the Authorised FUJIFILM NZ Outlet (or in the case of a Qualifying Product from instax.co.nz, the receipt issued by FUJIFILM NZ), or such other proof of the Qualifying Product as is acceptable to FUJIFILM NZ in its sole discretion; and
    • you must submit the entry form electronically to FUJIFILM NZ, by clicking “submit” on the electronic application form. Please note, only properly completed entry forms (ie entry forms that include all the correct information specified at paragraph 4.2) that are received by FUJIFILM NZ during the Promotional Period will be valid entries under this Promotion and the Prize draw.
  2. Only one entry form may be completed per Qualifying Product purchased.
  3. All entry forms must be validly lodged and received by FUJIFILM NZ no later than 23:59 on Friday 6th September 2024. FUJIFILM NZ will not process any entry forms received after this date and is not responsible for late, lost, incomplete, incorrect or misdirected entry forms that have previously been submitted to FUJIFILM NZ.
  4. To avoid doubt, you may not opt-out of redeeming a Tumbler when you submit an entry form.
  5. Your Tumbler will sent to you by tracked courier within 25 business days of the submission of your entry form at FUJIFILM NZ’s expense.

How will I know if I have won a Prize?

  1. Each validly submitted entry form received by FUJIFILM NZ during the Promotional Period will receive 1 entry into the draw to win a Prize.
  2. The Prize draw will take place at FUJIFILM NZ’s offices on 9th September 2024. If any of the successfully-drawn entry forms are later rejected in accordance with these Terms and Conditions, then FUJIFILM NZ reserves the right to make subsequent further draw(s) to draw such additional winners as are necessary to ensure that all Prizes are won by participants who have followed the Terms and Conditions of this Promotion.
  3. FUJIFILM NZ will notify each successful winner using one of the contact details provided in the entry form and request that such winner provides to FUJIFILM NZ the necessary information to validate that winner’s entry and enable delivery of the Prize (including providing details of a postal address and age). If we do not receive all required information within 5 business days of us notifying you of your win, we may reject your successfully-drawn entry and carry out subsequent Prize draws (see paragraph 9).
  4. The successfully verified winners will be sent their Prize within seven (7) business days of being verified by FUJIFILM NZ. The Prize will be sent via tracked courier to the delivery address on the winner’s entry form.
  5. FUJIFILM NZ will publish the names of all of the winners at https://www.instax.co.nz/promotions/ on 23rd September 2024.

What are the Qualifying Products?

  1. To participate in the Promotion, you must purchase one of the following instax products described in the table below. The Promotion does not apply to any FUJIFILM NZ products other than the FUJIFILM instax products listed in the table below.

  1. Each Qualifying Product that is purchased during the Promotional Period will entitle a participant to submit 1 entry into the Prize draw. For example, if two Qualifying Products are purchased then you are entitled to submit 2 entries into the Prize draw.
  2. Qualifying Products must be new, and be paid for in full in a single transaction.

Who is running this promotion?

  1. FUJIFILM NZ Limited of 2C William Pickering Drive, Rosedale, Auckland 0632 is the promoter of this Promotion.

What is the Prize pool?

  1. The total Prize value of this Promotion is $2,500, consisting of 5 Prizes. Each Prize is 1 x $500 gift card bundle containing the following gift cards and values:

What personal information of mine may be collected and on what terms? 

  1. As a condition of entering this Promotion:
    • you consent to FUJIFILM NZ publishing your name (if you are a Prize winner) on the instax website https://www.instax.co.nz/promotions/
    • you consent to FUJIFILM NZ using your personal information to administer the Promotion, including disclosing the FUJIFILM Customer’s personal information to organisations that assist FUJIFILM NZ with administering this Promotion; and
    • you consent to FUJIFILM NZ using your personal information for future marketing purposes, unless otherwise advised by the FUJIFILM Customer. You may access and correct any personal information held by FUJIFILM NZ, upon request to FUJIFILM NZ.
  2. FUJIFILM NZ respects the privacy of its customers. Any personal information collected in relation to this Promotion will be collected, held, used and disclosed in accordance with its privacy policy, which is available at https://www.fujifilm.com/nz/en/privacy.

What other things should I know about the Promotion?

  1. FUJIFILM Customers who participate in this Promotion are deemed to have agreed to be bound by these Terms and Conditions.
  2. The Promotion is only open to FUJIFILM Customers who purchased the Qualifying Product in New Zealand, are residents of New Zealand (and so have a postal address in New Zealand) and who are at least 18 years old.
  3. FUJIFILM NZ reserves the right to accept or reject any entry form that is incorrect, incomplete or otherwise does not meet the requirements of these Terms and Conditions.
  4. If FUJIFILM NZ discovers any fraudulent conduct in respect of any entry, FUJIFILM NZ reserves its rights to reject any entry form and pursue any legal action available to it.
  5. Any tax liability, which may arise as a result of winning any Prize, will be the sole responsibility of the relevant Prize winner.
  6. FUJIFILM NZ excludes all liability for any loss, damage or injury of any nature howsoever caused or sustained by any participant under this Promotion (except in the case of a participant that is a winner under the Prize draw and who has fully complied with these Terms and Conditions where liability is instead limited to $500).
  7. FUJIFILM NZ is not liable for any failure to fulfil the Promotion or to satisfy any of these Terms and Conditions or for any terms which may be imposed on a Prize winner by a third party organisation in connection with the Prize, owing to circumstances beyond its reasonable control.
  8. To the extent permitted by law, FUJIFILM reserves the exclusive right to amend these Terms and Conditions as may be reasonably required to address any issue that arises during the Promotional Period that impacts the efficient running and operation of the Promotion.
  9. Prizes are not exchangeable or transferrable.
  10. A decision by FUJIFILM NZ in relation to the Promotion is final and no correspondence or discussion will be entered into.
  11. Employees of FUJIFILM NZ, its subsidiary companies, franchisees, their families, agents, retailers and other parties directly involved with this Promotion are not eligible to participate in this Promotion.
  12. These Terms and Conditions are governed by the laws of New Zealand.
