Terms and Conditions
What is this Giveaway?
1. This prize draw promotion (“Giveaway”) is jointly promoted by FUJIFILM NZ Limited (“FUJIFILM NZ”) of 2C William Pickering Drive, Rosedale, Auckland 0632 and AS Colour Limited (“AS Colour”) of 4 Kakano Road, Westgate, Auckland 0814 (together, the “Promoters” and each a “Promoter”).
2. By entering the Giveaway, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not enter.
3. FUJIFILM NZ is responsible for administering the Giveaway, including selecting and contacting the winner.
4. This Giveaway is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram or Meta. By entering, participants completely release Facebook, Instagram and Meta from any liability associated with the Giveaway.
How do I enter?
5. The Giveaway is free to enter. No purchase is necessary to enter or to have a chance to win a prize.
6. Entrants must follow the instructions set out in the relevant Giveaway post. The opening and closing dates will be specified in that post.
7. Late, incomplete, lost, misdirected or illegible entries will not be accepted. The Promoters accept no responsibility for technical failures or any issue preventing an entry from being received.
Who can enter?
8. The Giveaway is open to entrants who are resident in New Zealand. Entrants must be aged 18 years or over.
9. Employees, contractors, consultants, directors and immediate family members (including de facto spouses) of either Promoter, their related companies, agencies, or anyone directly involved in administering the Giveaway are not eligible to enter.
10. The Promoters reserve the right to refuse entry or award a prize where doing so would breach any applicable law or regulation.
How will the winner be selected?
11. The winner will be selected at random from all eligible entries received during the Giveaway period, unless otherwise stated in the Giveaway post. No entrant may win more than one prize.
12. FUJIFILM NZ will notify the winner via the relevant social media platform or by direct message. If the winner does not respond within five (5) business days, FUJIFILM NZ may redraw the prize.
13. The prize will be as described in the Giveaway post and may include products supplied by both FUJIFILM NZ and AS Colour.
14. Prizes are not transferable, exchangeable or redeemable for cash.
15. The Promoters will arrange delivery of the prize where reasonably possible. If shipping restrictions, customs requirements or local laws prevent delivery of all or part of the prize, the Promoters reserve the right to substitute that item with one of equal or greater value.
16. The Promoters accept no responsibility for prizes that are lost, damaged or delayed after dispatch.
17. Where any component of the prize is supplied by a third party, that supplier is solely responsible for providing that component and any terms imposed by that supplier will apply.
What personal information may be collected?
18. By entering the Giveaway, you consent to the Promoters collecting, holding and using your personal information for the purpose of administering the Giveaway, contacting the winner and fulfilling the prize. Where you have consented to receive marketing, the Promoters may also send you marketing communications about their products and services.
19. You consent to your personal information being shared between the Promoters, their respective related companies, agencies and service providers where reasonably necessary for the administration of the Giveaway and fulfilment of the prize or otherwise as required by law.
20. Personal information will be handled in accordance with FUJIFILM NZ’s Privacy Policy (https://www.fujifilm.com/nz/en/privacy) and AS Colour’s Privacy Policy (https://www.ascolour.co.nz/privacy-policy).
21. By accepting the prize, the winner agrees that the Promoters may use the winner’s name, town or city of residence, photographs and Giveaway entry for promotional, marketing, publicity and public relations purposes without further compensation, unless prohibited by law.
22. By entering the Giveaway, you warrant that you are eligible to enter under, and will comply with, these Terms and Conditions.
23. The Promoters reserve the right to verify the validity of any entry and to disqualify any entrant who tampers with the entry process or breaches these Terms and Conditions.
24. If fraudulent, misleading or automated entries are identified, the Promoters reserve the right to reject those entries and take any action available at law.
25. The Promoters reserve the right to amend these Terms and Conditions, to substitute a prize with one of equal or greater value, suspend or cancel the Giveaway where reasonably necessary.
26. The decisions of FUJIFILM NZ regarding the administration of the Giveaway, including winner selection, are final and no correspondence will be entered into.
27. Nothing in these Terms and Conditions limits or excludes any rights available under applicable consumer protection laws.
28. To the maximum extent permitted by law, the Promoters exclude all liability arising from or in connection with the Giveaway or any prize, except where liability cannot legally be excluded.
29. The Promoters are not liable for any failure or delay in performing their obligations in connection with the Giveaway where the failure or delay is caused by circumstances beyond their reasonable control.
30. Each Promoter is responsible only for its own acts and omissions in connection with the Giveaway. Neither Promoter is liable for the acts or omissions of the other Promoter, and nothing in these Terms and Conditions creates a partnership, joint venture or relationship of joint liability between the Promoters.
31. The Promoters accept no responsibility for any tax implications arising from acceptance of the prize. Entrants should seek their own independent financial advice where appropriate.
32. Failure by either Promoter to enforce any right under these Terms and Conditions does not constitute a waiver of that right.
33. You may not assign or transfer any of your rights or obligations under these Terms and Conditions.
34. These Terms and Conditions are governed by the laws of New Zealand.
